The Promoter and/or sponsors will not be liable for a person missing a closing date due to system failures, network error, site being down, hacks on the system or personal computer issues.

The Promoter will not accept Codes that cannot be read due to defective or torn tickets. If the Code cannot be read due to a genuine printing error, please return the ticket to the Promoter at TgSOE Consumer Services, PO BOX 331, Carterton, Oxon, OX18 1ZN.

You acknowledge that the Promoter and/or sponsors reserve the right to reject any offer to buy due to unavailability of stock.

The Promoter and/or sponsors will not be responsible if you do not receive the item you won on the website if you have supplied insufficient, incorrect or false information when you registered on the Website.

The Promoter and/or sponsors are not responsible for any mail handling error of any postal service involved in the delivery of a prize. No exchange or refund of a prize will be provided.

The Promoter and/or sponsors, their employees, contractors, suppliers and agents associated with this Promotion shall not be liable for and shall be held harmless for any loss, damage, injury or any other claim whatsoever which is suffered (including but not limited to direct or consequential loss) as a result of or arising from a person participating in this Promotion and associated publicity or in utilising the prizes won.

The Promoter and/or sponsors do not guarantee continuous, uninterrupted or secure access to the Website. Numerous factors outside of the control of the Promoter and/or sponsors may interfere with the operation of the Website. To the extent permissible by law the Promoter and/or sponsors excludes all implied warranties, conditions or other implied terms.

Any person suspected of cheating in the opinion of the Promoter through the manipulation of Codes or information on the Website or otherwise fraudulently falsifying data or acting in any way fraudulent in the opinion of the Promoter will be removed from the Promotion. Without limiting any other remedies, the Promoter may suspend or terminate your registration if the Promoter suspects that you have engaged or are about to engage in, or have been in any way associated with or involved in, fraudulent activity in connection with the Website.

Attempting to gain access to someone else’s registration details and/or information, or trying to get other people’s passwords is strictly forbidden and should you attempt to do this, your registration will be deleted, you will be permanently banned from the Website and the Promoter may decide to take further action.

You must not register on nor use the Website on behalf of another individual without that individual’s express permission.

The Promoter reserves the right to suspend or terminate the registration of any person who it reasonably suspects has violated or infringed any of these general terms and conditions.

You should retain your winning ticket codes. The Promoter may require you to submit original tickets as proof of purchase in order to claim a prize.

Successful winners may be required to take part in publicity.

The decision of the Promoter in relation to this Promotion will be final and binding and no correspondence will be entered into.

The individual sponsors shall be entitled to modify the Sponsor Terms and Conditions at any time during the Promotion by publishing any such modification in the Sponsor Terms and Conditions on the Website.

Winners’ names and counties will be made available on the Chocolotto website or by sending a stamped SAE to: “Chocolotto Winners” TgSOE Consumer Services, PO BOX 331, Carterton, OX18 1ZN after the closing date of the promotion referred to.

Headings in these general terms and conditions are for convenience only and are not to be taken into account in the interpretation of any of the terms set out in these terms and conditions.

If any part of these general terms and conditions are found by a court of competent jurisdiction or other competent authority to be invalid, unlawful or unenforceable then such part will be severed from the remainder of these general terms and conditions, which will continue to be valid and enforceable to the fullest extent permitted by law.

These general terms and conditions shall be governed by and construed in accordance with English law and subject to the exclusive jurisdiction of the English courts.
